Dear Sir/Madam,i am an accountant of a Service oriented Com, My doubt is Can we claim Service tax which we have paid on Telephone bills etc from our total Service tax collection as per our Invoice?
Yes. you can claim input service credit of landline telephones and mobile phones (in company’s name) subject to the condition that the service is used for providing taxable service.
As per clarification dated 23.08.2007 issued by CBEC, credit on mobile phone is also permissible and also there are number of court judgments on the issue.

The service tax is collected by the telphone service provider and the same is deposited to government treasury.

Yes, Your Company is Service Providing Co., hence, the roll of Telephone is important for proving services. So, can claim of service tax paid on Telephone Bills

Service tax paid as per telephone bills is available for input credit.
However, note that only land line phones installed at business premises are eligible. Forget Mobile Phones for this purpose.
