  • can an accountant withhold w2s to employees if business owner is delinquent in payment for accounting services?

Posted by admin on February 9th, 2010 and filed under accounting services | 4 Comments »

I have not received my w2. The accountant said she has not processed them because the owner of business i was working for is delinquent on payment for their payroll services. Is that legal?

The accountant isn’t required to work for free for a deadbeat who isn’t paying him. The employer is legally responsible though for getting your W-2s to you.

Sounds like the problem is the employer, not the accountant. Ask them why they haven’t paid yet.

That’s definitely a problem. You should take care of this ASAP. Here’s something that can help you out. Good luck my friend.

"If your employer still refuses to give you Form W-2, call the IRS at 1-800-829-1040. The IRS advises that you should have the following information ready:

      * The employer’s name and complete address, including zip code, the employer’s identification number (if known), and telephone number,
      * Your name and address, including zip code, Social Security number, and telephone number; and
      * An estimate of the wages you earned, the federal income tax withheld, and the dates you began and ended employment. (From Missing Your Form W-2?)"
